On Wednesday, 8th August, 2018, the Consumer Protection Council (CPC) and the National Agency for Food and Drug Administration and Control (NAFDAC) operating in furtherance of their respective mandates to proactively protect the rights of the Nigerian consumer and ensure that food products distributed in Nigeria are of the highest safety and quality standards, conducted a site visit at Krispy Kreme, Victoria Island, Lagos State. Q.F.A Nigeria Limited (Q.F.A) is an operator of premium food outlets in Nigeria, including Krispy Kreme, and is committed to supporting the various regulatory bodies, including CPC and NAFDAC. Initial assessment and findings indicated that some of Krispy Kreme’s doughnut mixes and doughnut fillings had not received prior Nigerian regulatory approval for validation of shelf life extension, although documents furnished by Q.F.A indicated that QFA’s aforementioned validation of shelf life extension was with the concurrence of Krispy Kreme Doughnut Corporation Inc. (KKDC) and in line with KKDC’s independently verified internal quality control and food safety protocols. Additionally, a larger portion of the doughnut mixes and doughnut fillings are within their indicated original shelf life, are in no need of extension or validation, and were thus not affected. Further scientific laboratory investigations by NAFDAC and other regulatory investigations by CPC have continued, and Q.F.A has submitted documents and relevant stock for evaluation. Both regulators therefore agree that there is a vital consumer interest that will be served with Krispy Kreme’s ability to reopen and continue operations within the parameters approved by the regulators.
